Bart Krans speaker at international seminar in Norway
Bart Krans, Professor of Private Law and Civil Procedure, spoke about ‘procedural agreements and ex officio application of EU law’ at an international seminar that was held at the University of Bergen in June. The results of the seminar will be published in 2023.
The participants at the seminar on contractualisation of civil litigation discussed various aspects of contractualisation of court proceedings. Parties are increasingly allowed to agree to deviate from the regular rules of civil procedure, by entering into agreement on, for instance, choice of courts and division of litigation costs.
Questions dealt with at the seminar included: What are the advantages and disadvantages of procedural contracts? Under which circumstances should the court exercise control of the agreement and what should be the scope and intensity of the control?
