Starting from key philosophical schools – from logical positivism to critical theory – we explore fundamental themes such as the nature of social and institutional facts, the role of language in law, and the distinction between external and internal perspectives on law. A central topic in the philosophy of science is the demarcation problem: how to distinguish science from non-science or pseudoscience. Throughout this course, we, therefore, critically reflect on law as a science.
