Description

The classical foundations of international criminal law and criminal responsibility are centered on human agency and volition.  AI is a form of power. It is increasingly used in armed conflicts, the investigation of international and economic crimes or Court management practices. It poses new epistemic, structural and legal/ethical challenges and affects all agents in proceedings (Judges, Prosecution, Defence, Victims). In this panel, we will explore how it impacts the culture of criminal investigations and prosecutions, to what extent it forces us to re-think fundamental norms and institutions or criminal law, and how some of its present and future risks and challenges (e.g., fairness, inequalities, governance issues) can be addressed.

  • Prof. Michael Scharf, Joseph C. Hostetler Professor of Law & Associate Dean, Case Western Reserve University
  • Mr. Matthew Cross, Appeals Counsel, International Criminal Court
